The terms that govern use of the Apex website and player portal.
Effective October 1, 2026 · Last updated October 1, 2026
These Terms of Service (“Terms”) are a legal agreement between you and Bills Sports Group LLC, which operates Apex Baseball Academy (“Apex,” “we,” “our,” or “us”), and govern access to and use of the Apex public website and player portal (together, the “Services”). Please read them carefully.
By accessing or using the Services, using an account, or registering a player in an Apex program, you accept these Terms and agree to be bound by them. If you do not accept them, you must not use the Services. If you accept on behalf of a player, you represent that you are the player’s parent or legal guardian or are otherwise authorized to act for the player.
These Terms are separate from, and do not replace, the packet of forms a parent or guardian signs for each player each season — the registration form, the season participation agreement, the liability waiver and assumption of risk, the medical consent and medical information form, and the photo and media consent (together, the “Player Contract, Waivers & Consents,” or the “Contract”). As between the two, the signed Contract controls any matter concerning participation in a program, risk of injury, medical treatment, or use of a player’s photograph; these Terms control any matter concerning use of the website or portal. Our Privacy Policy explains how we handle information and forms part of these Terms.
Apex provides youth baseball teams, instruction, and athletic training in Maryland and the surrounding Delmarva area, and operates this website and the portal for the families, coaches, and staff who take part in our programs.
The Services exist to administer our programs and to communicate with families. The portal is an internal tool, not a public forum, and does not replace the notices, forms, and communications we provide directly.
(a) Adults only. Accounts are created by Apex staff and issued only to adults — parents, guardians, coaches, and staff — except that a player aged 13 or older may hold a player account with a parent’s or guardian’s consent. A player account may view that player’s own team, schedule, and statistics, and may not edit roster or registration information. No account is issued to a child under 13.
(b) Accurate information. You agree to provide accurate and current information, to keep it up to date, and to correct anything that becomes inaccurate. We rely on that information — including emergency contacts and medical information — to keep players safe.
(c) Your credentials. You are responsible for keeping your password confidential and for all activity under your account. Do not share your sign-in details. Tell us promptly if you believe your account has been accessed without your authority.
(d) Account-level access. The portal limits each family to its own players’ information. You agree not to attempt to reach another family’s information, or to copy, distribute, or use information about other families or players for any purpose outside our programs.
(a) Registration for each season requires a completed and signed Contract and payment of the applicable fees before a player may participate.
(b) A parent or guardian is responsible for the player’s participation, for the conduct of family members and guests at our facilities and events, and for compliance with these Terms and our program policies.
(c) You agree to notify us promptly of any change to a player’s medical condition, medication, allergy, or ability to take part, so that we can respond appropriately.
(a) Program fees, dues, and other charges are set by Apex and are communicated before registration or before the applicable activity.
(b) Payment may be made by card through our payment provider, or by check or cash delivered to us or mailed to the address we provide. Card payments are handled by the provider and are subject to the provider’s own terms; we do not receive or store card or bank account numbers.
(c) Unless we agree otherwise in writing, fees are due by the date stated at registration. We may suspend a player’s participation and portal access while an account is past due, and may pursue unpaid amounts as the law allows.
(d) We may adjust fees for future seasons. An adjustment does not affect fees already paid for the current season.
(a) Except as stated in subsection (c), all fees are non-refundable. Registration fees, season dues, tuition, uniform and equipment charges, and tournament fees are earned when paid and are not refundable, in whole or in part, except as required by applicable law.
(b) No fee is refunded or reduced because of a missed practice, lesson, training session, or game; because of a suspension or removal for cause; because a season is shortened by weather, field or facility availability, or other reasons beyond our control; or a family’s decision to leave a program.
(c) Where Apex cancels a program before it begins and does not reschedule it, we will issue a credit or refund for that program.
(d) A player who leaves a program remains responsible for any balance due and for costs we have already committed on the player’s behalf, such as tournament entry fees and uniform orders.
(a) Schedules, rosters, practice locations, and program details may change. We communicate changes through our normal team channels and, where appropriate, through the portal.
(b) Team placement, position, playing time, and roster decisions are made by our coaches and staff and are within their discretion. Registration does not guarantee placement on a particular team or in a particular position, or any amount of playing time.
(c) We may modify, suspend, or discontinue a program, session, or event where we consider it necessary for safety, weather, facility availability, or the quality of the program.
(a) Our programs exist for the benefit of the players. You agree to treat players, coaches, officials, opponents, and other families with respect, and to refrain from harassing, abusive, discriminatory, or intimidating conduct, whether in person, at our facilities and events, or through the Services.
(b) Parents and spectators are expected to support the players and the officials, and to refrain from coaching from the stands, disputing calls, or confronting officials or opposing families.
(c) We may remove any person from a program, facility, or event, and may suspend or terminate an account, for conduct that in our reasonable judgment is inconsistent with this section.
(a) Baseball and athletic training involve inherent risks of injury, including serious injury. Nothing in these Terms reduces or replaces the acknowledgment and assumption of risk, the medical consent, or the waiver provisions of the Player Contract, Waivers & Consents, all of which remain in full force and effect.
(b) You consent to our staff taking reasonable steps to obtain emergency medical treatment for a player when a parent or guardian cannot be reached, as provided in the Contract and consistent with the medical information on file.
(c) We do not provide medical advice. Information or instruction offered through the Services is general in nature and is not a substitute for the advice of a qualified professional.
Photographs taken at practices, games, and team events may be used in general site artwork and on the Academy’s social media, as described in our Privacy Policy and in the Contract. Such photographs are not captioned or labeled with a player’s name, and no player’s portal photograph is displayed on any public page. Any other use of a player’s image or likeness requires the consent given in the Contract.
(a) Where you send us messages, photographs, documents, or other content through the Services — for example, through a contact form or a message to a coach — you confirm that you have the right to send it, that it does not infringe the rights of any other person, and that it contains no unlawful material.
(b) You give us permission to use that content as needed to operate our programs, respond to you, and keep our records, consistent with our Privacy Policy. We do not acquire ownership of it.
(c) Our email, forms, and messaging channels are not a secure means of transmitting sensitive information. Do not send sensitive information through them; where we require it, we will provide a specific method for doing so.
You agree not to:
The Services, and the Apex name, logo, and content on them, are owned by us or our licensors and are protected by law. Subject to these Terms, we grant you a limited, revocable, non-transferable license to access and use the Services for the purposes described in these Terms. You may print or save pages for your own family’s use. You may not otherwise reproduce, distribute, modify, or create derivative works from our content, or use our name or marks, without our written permission. Photographs and artwork supplied to us by others remain the property of their owners and are used with permission. If you believe that content on the Services infringes your rights, please contact us.
The Services link to, and depend upon, services we do not control, including our payment provider, team communications tools, online team store, hosting and database providers, and social media pages. Those services have their own terms and privacy policies, and we are not responsible for them. Dealings you have with a third party are between you and that party.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ROSTER, SCHEDULE, STATISTICS, OR OTHER INFORMATION IN THE PORTAL WILL BE COMPLETE OR ACCURATE. Statistics are unofficial, are maintained by our staff, and may be corrected or revised. Notices given through the Services are a convenience and do not replace the notices we provide directly.
TO THE FULLEST EXTENT PERMITTED BY LAW, APEX AND ITS MEMBERS, OFFICERS, EMPLOYEES, COACHES, AND VOLUNTEERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PROGRAM GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law, or any liability under the Contract.
You agree to indemnify and hold harmless Apex and its members, officers, employees, coaches, and volunteers from any claim, loss, liability, and expense (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms, (b) your misuse of the Services, or (c) content you submit to us. This does not apply to claims caused by our own negligence or willful misconduct, or to any matter the Contract provides otherwise.
We may suspend, disable, or terminate an account, or a player’s participation, at any time if you breach these Terms or our program policies, if a balance is unpaid, if the law requires it, or if we determine that continued participation is not in the interest of a player or of our programs. You may ask us to close your account at any time. Provisions that by their nature should survive termination — including those addressing refunds, risk, intellectual property, disclaimers, liability, indemnification, disputes, and general provisions — will survive.
(a) Please contact us first. If a dispute arises, we will try to resolve it with you directly. If it is not resolved within thirty (30) days, either of us may proceed as provided below.
(b) Governing law. These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules.
(c) Court venue. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Maryland, and each of us consents to venue and personal jurisdiction there. Either of us may bring an individual claim in small claims court if it qualifies.
(d) Certain remedies preserved. Nothing in these Terms prevents either of us from seeking relief for the protection of intellectual property, or any other remedy that cannot lawfully be limited.
(e) No class actions. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND APEX EACH AGREE THAT A DISPUTE WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this subsection is found unenforceable as to a particular claim, that claim will be severed and brought individually, and the remainder of this section will still apply.
(f) Relationship to the Contract. Nothing in this section limits the release, waiver, or assumption of risk in the Contract.
We may update these Terms. If a change is material, we will update the date at the top of this page and notify account holders directly. Continued use of the Services after an update constitutes acceptance of the revised Terms. If you do not accept a change, you may stop using the Services and ask us to close your account.
(a) You agree that we may communicate with you electronically about your account and your player’s participation, including through the portal, by email, and through our team messaging channels, and that electronic communications satisfy any requirement of written notice under these Terms.
(b) You agree that agreements and consents connected with the Services — including these Terms, the Contract, and any form we send for electronic signature — may be provided and signed electronically, and that an electronic signature has the same effect as a handwritten one. To receive and sign electronically you need a device with a current web browser and an email address you can access. You may withdraw your consent to electronic signatures at any time by telling us, as described in section 23, that you want to use paper forms instead, and we will provide any of these documents on paper, at no charge, on request. Withdrawal does not affect agreements already made electronically.
(c) Please keep the email address on your account current so that you receive our notices.
(a) These Terms, together with the Privacy Policy and the Contract you sign, are the entire agreement between us concerning the Services, and supersede prior understandings on that subject.
(b) If any provision is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be enforced to the greatest extent the law permits.
(c) Our failure to enforce a provision is not a waiver of it, and a waiver on one occasion is not a waiver on another.
(d) You may not assign or transfer these Terms. We may assign them in connection with a merger, sale, or reorganization.
(e) Notices to you may be given through the Services or to the email address on your account. Notices to us must be given as described in section 23.
(f) Section headings are for convenience only and do not affect interpretation.
Questions about these Terms may be directed to us through the contact form on our About page or by direct message on our Instagram or Facebook pages. Formal notices must be sent to Bills Sports Group LLC at the mailing address we provide on request.
